Analysis

This bill would move the issuing of marriage licenses to be a function of the Secretary of State, with counties issuing license by authority of the Secretary. This bill would also allow the Secretary of State to deny a county the ability to issue marriage licenses if they violate Section 32, Article I of the Texas Constitution, which is the provision that defines marriage as between one man and one woman.

This bill and its companion were filed the day after, and in response to, Travis County issuing a marriage license to a same-sex couple, after a judge ruled the Texas Constitutional provision mentioned above to be in violation of the United States Constitution.

Position

It is regretful that lawmakers in Texas are so committed to enforcing their personal and religious morals through law that they not only ignore the freedoms guaranteed by the Texas and United States Constitutions, but also seek to restructure our government in order to exert that control.
