Analysis

This bill adds to the list of classes protected from insurance discrimination.  In addition to race, color, religion, national origin, age, gender, marital status, geographic location, disability, and partial disability, it adds sexual orientation and gender identity.  This covers all types of insurance in Texas, including medical, although the Affordable Care Act mandates these classes are protected by non-discrimination in medical insurance.  This bill more diligent in reviewing the text of the original law and ensures that a reference in the law is also updated.  Although the ACA has protected LGBT persons, this may have major implications for life insurance in the LGBT community.  

Position

Secular Texas supports the inclusion of sexual orientation and gender identity as protected classes in for all insurance transactions in Texas.  We recommend that the wording of HB 304 be considered over SB 76 and HB 453 so that all cross references are updated in the law as well.
